Cigarette Health Warning Label Requirements

In 2020, FDA finalized a rule establishing new health warning labels for cigarette packages and advertisements. As part of its rule, retailers are required to submit a plan to FDA if they create or produce cigarette advertisements. However, a US District Court issued an order vacating and setting aside the final rule in August 2025. FDA is appealing that decision. At this time, retailers do not need to comply with the rule’s requirements.
