How To Prepare for Immigration Enforcement Actions

A recent NACS webinar provided guidance on how to respond if federal immigration officers arrive at your workplace.

In today’s regulatory environment, it’s more important than ever for businesses to be prepared for potential immigration enforcement actions.

“The Justice Department used to not pursue criminal penalties very much in immigration or undocumented worker situations in the past unless there was some sort of conspiracy. But now, they’ve taken a more aggressive approach on criminal penalties and said they will use all ‘available criminal statutes to combat the flood of illegal immigration,’” said David Jones, regional managing partner and national immigration practice co-chair at Fisher Phillips LLP, in the recent NACS webinar “How to Prepare for Immigration Enforcement Actions.”

The webinar discussed the tools and knowledge needed to navigate immigration enforcement. Currently, the Executive Orders in place and other relevant actions include mass deportation initiatives, revocation of parole and revocation of temporary protected status.

“Lately, they have been going after anyone who has a status issue. U.S. Immigration and Customs Enforcement (ICE) is going out where they can and looking for people, but they’re really focused on going where these people are going to be, which is worksites,” said Jones.
