White House Asks Congress to Reconsider Hemp Sales

Plus, the White House asked for the permanent, year-round sale of E-15.

The White House yesterday sent its supplemental funding request to the House of Representatives. The letter includes two requests that are NACS priorities: the sale of hemp products and the year-round sale of E15. The letter urges Congress to act as soon as possible.

Regarding hemp sales, the letter states:

“The Administration requests additional authorities that it strongly supports. These authorities include revising the Federal regulation of hemp to ensure the fair treatment of hemp products in a manner consistent with Amendment #54 offered to H.R. 8646 in the House Rules Committee, or, at minimum, an extension of implementation of the regulatory framework put in place by Section 781 of Public Law 119-3.

This request would update the statutory definition of final hemp-derived cannabinoid products to allow Americans to benefit from access to appropriate full-spectrum CBD products while preserving the Congress’s intent to restrict the sale of products that pose serious health risk.”

The language references an Amendment to the House Agriculture Appropriations bill offered, and ultimately withdrawn, by Rep. Andy Barr (R-KY) which would set forth a federal regulatory structure that would allow for the continued sale of hemp derived products. The “extension of the regulatory framework...” language refers to a delay in the November deadline. NACS supports Congress moving in a permanent regulatory framework but would also support such a delay to give Congress time to pass such a framework. 

A federal ban on hemp-derived THC products set to go into effect November 2026 would eliminate most intoxicating hemp products nationwide, closing the so-called “hemp loophole” left by the 2018 Farm Bill. Without legislative intervention, the THC ban would force a major reset for manufacturers and retailers of this rapidly growing category in c-stores.

The letter from the White House also asked for the “urgent and needed fix” to allow the permeant, year-round sale of E-15, stating:

“The Administration requests a fix that codifies the permanent, year-round sale of E-15, an urgent and needed policy change that would expand consumer choice, support domestic fuel production and provide additional flexibility in fuel markets.”

In May, the House passed a bill allowing the year-round sale of E15. NACS has continually advocated for the year-round sale of E15 fuel.
