Today, EPA announced it was using its emergency waiver authority to allow for the sale of E15 this summer. This is the third year in a row that EPA has taken this action. The waiver will temporarily exempt E15 from restrictions that in effect block sales across the country during the warmest months of the year. Details on the waiver can be found here.

“We applaud EPA for granting this emergency waiver and allowing E15 to be sold this summer,” stated Paige Anderson, director of government relations at NACS. “This action is important to fuel retailers as it is vital that our members have a consistent, reasonably priced gasoline supply, especially as we face an uncertain economic climate this summer.”

NACS supports EPA using its emergency waiver authority to allow summer sales of E15. Earlier this spring, NACS joined NATSO and SIGMA in a letter to EPA asking for the waiver. 

EPA stated that this emergency waiver is in the public interest and cited the conflicts in Ukraine and the Middle East as putting additional pressure on the global energy supply chains. EPA has also indicated that additional waivers may be needed throughout the summer.

With global supply challenges and increased volatility in the fuel supply markets, the ability to bolster energy security, protect fuel supplies and improve gasoline’s emissions characteristics are important to retailers and consumers alike.

NACS has been working with a broad group of stakeholders to pass legislation that would provide a permanent solution to ensuring the year-round sale of E15. One of the key issues facing fuel retailers who want to sell E15 is the inability to sell E15 year-round.
