Temporary Injunction Stops Mandated Free Air at Gas Stations

A judge has ordered a N.Y. town to halt the imposition of fines on gas stations who refuse to follow the ordinance.

HEMPSTEAD, N.Y. – Two years ago, the Town of Hempstead passed a law that required gas stations within its limit to provide free air to drivers. This week, a judge issued a temporary injunction to stop the town from levying fines on stations not in compliance, CBSNewYork reports.

Retailers protested the law, pointing out their costs in running and maintaining air machines. Previous town officials had countered that such a law helped keep motorists safe. Kevin Beyer with the Long Island Gasoline Retailers Association said his group attempted to come to a different solution for the town. “We told the town, the company that installs this equipment said, ‘We would put free air at certain sites around the town – at their parks, they would have a spot that they can go get the free air if they need it,’” he said.

Beyer also relayed that most retailers would provide air free of charge for a driver without funds in an emergency situation. “They would automatically get air,” he said. “If they were stuck in an emergency situation, we would provide the air for them.”

The temporary injunction stops the enforcement until the court case resumes next week.
