New York City Seeks Soda Ban Revival

Mayor Bloomberg’s administration is seeking a reinstatement of the city’s ban on sugary drinks.

NEW YORK CITY – Lawyers for Mayor Bloomberg’s administration went to court yesterday, arguing before an appeals court to reinstate New York City’s ban on sugary drinks, NBC News reports.

The appeal comes three months after a judge struck down the law as an illegal overreach of executive power. 

The law would have banned restaurants, movie theaters and other foodservice locations from selling sugary drinks larger than 16 ounces.

A ruling by the state’s Supreme Court Appellate Division could take several months. The outcome could have broad implications for mayors who seek to address health issues such as obesity.
