Wyoming Legislature Targets RYO Machines

Wyoming joins a growing list of states targeting roll-your-own tobacco machines.

CHEYENNE, WY - Wyoming??s legislature earlier this week passed Senate File 83, which defines roll-your-own tobacco machines used in retail environments as tobacco manufacturers.

Wyoming joins a growing list of states ?" Connecticut, West Virginia, Virginia, and New York, among others ?" targeting the RYO machines, as they produce cigarettes at retail businesses that do not incur the same taxes as traditionally packed cigarettes.

The measure was supported by the Wyoming Petroleum Marketers & Convenience Store Association, which argued RYO cigarettes do not utilize fire-safe paper and they bypass tax laws.

The new law does not ban RYO machines but classifies them as "manufacturers" under Wyoming law, therefore requiring them to abide by the same rules that cigarette manufacturers follow.

The law does not regulate citizens who roll cigarettes with their own equipment.
