Washington Report: No Ruling on Proposed Card Settlement Appeal

NEW YORK - Tuesday??s expected U.S. Court of Appeals for the Second Court ruling on an appeal of the proposed swipe fee settlement that was announced July 13, 2012, has not yet been issued.

Once a ruling is reached, be on the lookout for an email communication from NACS that provides information on the ruling, including what it means to NACS members and how to address the settlement notices that will follow. The ruling will pave the way for settlement notices to reach retailers ?" and it will be up to you to opt out and/or object.

The settlement notices will be distributed to merchants across the country to opt out, object to or accept the proposed settlement. If you accepted Visa and/or MasterCard at any time between January 1, 2004, and November 27, 2012, you must also decide whether to opt out, object to, or accept the settlement. Even if you submitted a declaration objecting to the proposed settlement last fall, you will be required to respond to the notice and submit something in writing again if you want to opt-out of or object to the proposed settlement.
