WASHINGTON – Yesterday, the House Energy and Commerce Subcommittee on Commerce, Manufacturing, and Trade held a hearing to discuss the need for federal data breach legislation and what that legislation should look like.

The key issues raised in the hearing, entitled "What Are the Elements of Sound Data Breach Legislation?", included the need for a single federal standard, the timing of a consumer notification standard and trigger for enforcement. NACS has been working closely with policymakers to ensure that any data security and consumer notification standards are fair, apply to all parties equally and actually protect the consumer. As part of this ongoing effort, NACS submitted written testimony for the hearing record, available here

Witnesses at Tuesday's hearing included representatives of the Retail Industry Leaders Association, Public Policy for Tech America, Acxiom Corporation and a professor from Cumberland School of Law.

Earlier this month, President Obama announced a series of new legislative proposals designed to ratchet up cybersecurity protections in the wake of a massive data breaches, unveiling the Personal Data Notification and Protection Act, a proposed bill that would require all corporations to notify consumers within a month if their personal information had been exposed in a data breach.
